Terms and Conditions – Fresco

1. Introduction

These Terms and Conditions ("Terms") govern the use of the mobile application Fresco ("App"), operated by Mattia Cannavò, individual, based in Italy ("Owner", "we", "us").

By downloading, accessing, or using the App, the user ("User", "you") agrees to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of the Service

Fresco is an informational application focused on nutrition awareness and food quality, including but not limited to:

• food product analysis,
• information related to ultra-processed foods (UPFs),
• educational insights about eating habits and nutrition.

⚠️ Fresco is not a medical or diagnostic application.

3. Sources of Information & Data Accuracy

The nutritional information, food data, scores, evaluations, and insights provided within Fresco may derive from:

• Open Food Facts, an open and collaborative food database,
• Automated analyses generated through modern Large Language Models (LLMs) and algorithmic systems.

The User acknowledges and agrees that:

• such information may be incomplete, outdated, or occasionally inaccurate;
• all nutritional values, classifications, and analyses are to be considered estimates only;
• the Owner does not guarantee the absolute accuracy, correctness, or completeness of the data.

Users are encouraged to:

• always verify information directly on product labels,
• consult official or professional sources when precision is required.

The App may be used by minors.

Users under the age of 18 are advised to use the App under the supervision of a parent or legal guardian.

6. Account Registration

To access Fresco, Users must create an account.

Users are responsible for:

• providing accurate information,
• maintaining the confidentiality of login credentials,
• all activities performed through their account.

The Owner reserves the right to suspend or terminate accounts in case of misuse or violation of these Terms.

7. Subscriptions & Payments

Fresco is available exclusively through paid subscriptions, processed by:

• Apple App Store
• Google Play Store

Available plans:

• Monthly subscription
• Annual subscription

Key conditions:

• No free trial is offered.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the billing period.
• Payments and cancellations are managed solely through the App Store or Play Store.
• The Owner does not directly manage billing or refunds.

8. User Data & Privacy

The App processes personal data related to food consumption and nutritional habits.

All personal data is processed in accordance with applicable laws and the Privacy Policy, which forms an integral part of these Terms.

Users are responsible for the correctness of the data they enter.

9. Acceptable Use

Users agree not to:

• misuse the App or its content,
• attempt to copy, reverse engineer, or resell the App,
• use the App for unlawful purposes,
• input misleading or fraudulent data.

10. Intellectual Property

All content, trademarks, software, algorithms, designs, and materials associated with Fresco are the exclusive property of the Owner or its licensors.

Unauthorized reproduction or distribution is prohibited.

11. Limitation of Liability

To the fullest extent permitted by law:

• The App is provided "as is" and "as available".
• The Owner does not warrant uninterrupted availability or error-free operation.
• The Owner shall not be liable for direct or indirect damages resulting from the use or inability to use the App or reliance on its content.

12. Service Changes

The Owner reserves the right to modify, suspend, or discontinue the App or these Terms at any time.

Continued use of the App after changes implies acceptance of the updated Terms.

13. Termination

Users may terminate usage at any time by canceling their subscription.

The Owner may suspend or terminate access in case of violations of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by Italian law.

Any dispute shall fall under the exclusive jurisdiction of the Court of Catania (Italy).
